President Biden’s vaccine mandate for big businesses came a step closer to reality on Tuesday after the Occupational Safety and Health Administration (OSHA) submitted the initial text of an emergency vaccine rule to the Office of Management and Budget for review.

Last month, the president announced that businesses with more than 100 employees would be required to mandate coronavirus vaccines or take weekly tests. Employers are also required to pay employees for time off to receive vaccinations and recover from side effects.


The rule will go into effect once the OMB completes its review and publishes it in the Federal Register.

“The Occupational Safety and Health Administration is working rapidly to develop an emergency temporary standard that covers employers with 100 or more employees to ensure their employees are fully vaccinated or Employees undergo weekly testing to protect against the spread of the coronavirus in the workplace,” a Labor Department spokesman said in a statement. “On Tuesday, October 12, as part of the regulatory review process, the agency submitted the preliminary text of the emergency provisional standard to the Office of Management and Budget.”

Two dozen Republican attorneys general have threatened to sue the administration in a joint letter dated Sept. 16, calling it “devastating and counterproductive.”

“From a policy standpoint, this fatwa is unlikely to win hearts and minds – it will only add to suspicion,” the letter addressed to Biden said. “And at least some Americans would rather leave the job market than comply.”

Businesses that don’t comply with the mandate could face fines from the government, but overtasked OSHA will likely rely on voluntary compliance, focusing its resources on repeat offenders, according to NBC News.

The administration has not given a timetable for the OMB review, but it is likely to be completed in the next few weeks.
