The accused, identified as Lenin Elisalde, returned home hours after being arrested for breaching the same property.

The Calaveras County Sheriff’s Office said the incident occurred on October 10, when they received reports of “forced entry” into a home in the 7000 block of Gabor Street in Valley Springs.

Two men waiting in the front yard of the residence inform deputies that Elisalde “kicked the front door to gain entry” into their residence.

Police said that “he started physically assaulting them” before the bosses shot him in self-defense. official press statement. “During the brawl, one of the occupants was dropped on the floor,” he said. “While on the ground and attempting to stand and fight Lenin, the second occupant pointed his pistol at Lenin more than once.”

During their investigation, detectives discovered that Elisalde had been arrested the day before for illegal entry on the same property. He was also charged with “vandalism and possession of methamphetamine.”

Elisalde was the son of the former owner of the house and informed police on his way to prison that he “believed that the residence was still his property and intended to return home.”

On the basis of his “unconditional statement of intention to return to residence”, the patrol deputy had sought an increase in his bail amount. However, the judge dismissed it because of the rape arrest charges against him.

The occupants of the residence were not arrested and detectives, in their initial investigation, found that Elisalde had “no legal right to take possession or return” to the property.

“The residence was completely vacant when it was purchased by new occupants and Lenin had no personal belongings or legal reason to return,” the sheriff’s office said.
