Linda O’Leary, wife of the “Shark Tank” star Kevin O’Leary, has been found not guilty in a boat accident that killed two people in 2019.
Ms O’Leary was charged with reckless operation of a ship when she was sailing a boat and collided with another motorboat Ontariohandjob Canada. Two people on the other boat were killed in the crash – 64-year-old Gary Poltash and 48-year-old Susanna Brito – and three others were injured.
Ms. O’Leary’s celebrity businessman husband, Kevin, was also on board her boat with a family friend at the time.
In his decision, Ontario Court Justice Richard Humphrey Governance That the lights on the other boat were off, making it difficult for Ms O’Leary to see, and so the accident at night was not necessarily the result of carelessness.
“The Purpose of the Enterprise in the Open Waters of Lake Joseph” [the second boat] was to obtain an unobstructed view of the night sky without the interference of artificial light,” the judge said. “This defies logic that they would have traveled to the place and activated the lights, the effect of which would have been to defeat their purpose.” would have been.”
The judge also ruled that there was no evidence that Ms O’Leary was intoxicated at the time of the accident.
Justice Humphrey observed, “For greater certainty, this Court concludes on the basis of the evidence before it that alcohol played no role as it was without due care and attention or due consideration to others in the issues of the operation of the ship.” is related to.”
Prosecutors had argued that in the dark of night, Ms O’Leary should have walked more slowly to avoid any potential burning boats. But the judge rejected that argument as well, noting that there was no evidence to prove how fast Ms O’Leary was driving.
Justice Humphrey said, “This submission almost states that no one should under any circumstances sail a boat at night.”
Granthshala Mister & Miss has reached out to O’Leary for comment on the verdict, but has yet to hear back.
