White van driver has admitted to running over and killing a woman after refusing to pay 50 pounds for oral sex.


James Martin, 27, carried Stella Frau hanging on the side of his van, old Bailey Heard.

The Old Bailey was told that as he collided with parked cars, the 38-year-old victim hit an Audi and fell under the van’s wheels.

Afterwards, Martin stops to buy a drink before returning home.

On Tuesday, he pleaded guilty to Ms Frau’s death by dangerous driving on the first day of his Old Bailey trial.

Prosecutor Jonathan Polnay plays CCTV of Martin driving his flatbed truck laden with scrap SUTTON, South London, about tea time on July 24 last year.

Ms Frau approached her, telling a friend she was “going to gain 30 pounds”, following Martin’s “wolf-whistle”.

The friend thought she was “going to have sex with the white van man or somehow extort some money from him”, Mr Polnay said.

In CCTV footage played in court, Ms Frau could be seen boarding the truck, which was driven off suburban streets.

An eyewitness said that seeing the truck parked, the driver’s door was open and a woman was bent over to give oral sex.

police Nearby were found a used condom with the defendant’s DNA and cigarette paper with Ms. Frau’s DNA on it.

Later, a pedestrian on Tonfield Road noticed a woman hitting the side of a truck, which was speeding, leaving her lying on the road.

A passerby saw him leaning against the window of the truck holding him with both hands.

According to the witness, the van sped away with the engine overturning as soon as Ms. Frau was hanging.

He heard a rumble and saw it lying on the road, the court heard.

Her passenger saw Ms Frau being dragged as the truck “zigzagged” between parked cars.

Traces of Ms. Frau’s blood were found on an Audi parked near where the victim had landed on the road.

Members of the public reached out to Ms. Frau and performed CPR before the medics took over.

He was later pronounced dead after suffering “extensive” injuries.

Mr. Polnay said: “Ms. Frau felt like a tire mark on her back, from her pelvis to her neck. She was crushed.”

He told the court that the incident appeared to have taken place due to the refusal of the respondent to pay the money.

He said: “His pocket was checked. He didn’t have any cash.

“He had only one bank card in his pocket. His handbag, which he could have seen earlier, was not found at the scene.

“The prosecutor suggests that the only reasonable conclusion is that it was in the defendant’s truck and that he at some point drove it before disposing of it.

“It is submitted that he had not paid him. She was clearly desperate to get the money and wouldn’t be willing to go without it – and even less so without her handbag.”

The police arrested the accused from his accomplice’s house.

In a prepared statement he gave a false excuse and claimed it was a “case of mistaken identity”.

He claimed he was on a settlement job in Earlsfield, South London, and stopped at a shop before returning home.

After CCTV evidence was shown, he admitted he was the van driver and was with Ms Frau, but said he had no intention of causing her death.

In a defense statement, Martin said Ms Frau gave her oral sex and later asked to pay £50.

She thought it was “too much” and she got argumentative and hit the van, yelling at her to let in, according to Martin.

As he left, he said he was unaware that Ms. Frau was hanging on in any way.

Martin, of Peaks Brooke Lane, Crawley, West Sussex, had denied murder and prosecutors accepted his plea for an alternative charge of death by dangerous driving.

Judge Richard Marks gave him an interim driving ban and adjourned the sentence until Thursday.
